Mr Nobela completed his articles of clerkship with one of the top black law firms in South Africa particularly in Road Accident Fund Claims, Kekana Hlatswayo Radebe Inc. and PGM attorneys respectively. Mr Nobela were exposed to a wide range of Personal Injures Claims (Motor vehicle Accident and Medical Negligence ) and matters ranging from the drafting of Legal Opinions , Negotiations in Settlement agreements and Defend the Claim , investigating Merits and Qunatum , appointing relevant Experts and Apearing at Court if the claims doesn’t necessitate appoinment of an Counsel .
We represent clients in civil and general commercial litigation. The firm has successfully assisted clients in major contractual disputes. In doing so, we ensure that we brief good counsel to litigate on High Court matters. Where stakes are high, we recommend to clients to brief senior counsel with expertise in the particular area of law.
We advise and represent clients at the Commission for Conciliation, Mediation and Arbitration (“CCMA”), the relevant sectoral bargaining councils, labour courts and private arbitrations, prosecute and preside over the disciplinary proceedings.
We possess extensive skills and expertise in this arena. Our in house Advocates have been involved in a plethora of internal disciplinary processes. We have acted both for employers and employees. In fact, the bulk of our labour related matters come from institutional clients, of which the majority of the work comes from municipalities. Labour law is the firm’s area of specialisation.
We advise and represent clients on pension fund matters. Mr M.O Nobela was part of a legal team at Kekana Hlatswayo Radebe Inc that was assigned to assist the office of the Pension Fund Adjudicator with regard to a backlog of pension fund complaints in terms of the Pension Fund Act, (“Act 24 of 1956”). It was from this involvement that Mr N.O Nobela gained an experience and expertise in pension law.
We preside over enquiries and inquests pertaining to the issues regulated in terms of the provisions of Occupational Health and Safety Act, (“Act 85 of 1993”) and its Regulations. In addition, we assist our clients with compliance issues in respect of the mentioned Act and regulations promulgated thereunder. Mr M.O Nobela possesses sound experience on Safety Law having represented various corporate clients by chairing inquests where employees either died or sustained serious injuries whilst on duty. We then prepare, based on the evidence that was presented by witnesses and the outcome of the inquests, a detailed report to be submitted by client to the Department of Labour.
We assist our clients with legal forensic audit, most particularly, with aspects pertaining to, amongst other things, irregular payments and other wasteful expenditures. Our expertise become of great relevance when it comes to issues contemplated in the provisions of Public Finance Management Act, (“Act 1 of 1999”) & Regulations, Local Government: Municipal Finance Management Act, (“Act 56 of 2006”) & Regulations and Preferential Procurement Policy Framework Act, (“Act 5 of 2000”). Upon completion of our audit, we prepare comprehensive legal due diligence investigation report/s for consideration by relevant authorities and/or authorised persons.
There is nothing as important as understanding the regulatory framework within which our clients operate. Our knowledge on regulatory law includes independent electoral commission, broadcasting and telecommunication law, shipping and maritime law, customs and excise law, WTO, dumping and anti-dumping measures, subsidies and countervailing measures.
In view of the sufficient experience and expertise that we have on Local Government Laws, administrative and constitutional law, we have assisted a number of our clients such as municipalities and Churches in the review and drafting of the Council’s Standing Rules and Orders and Compliance with bylaws.
